CaTpad expresses concern over judicial system in the North PDF Print E-mail
In an open letter the President Mahinda Rajapaksha, Prime Minister D M Jayaratne and Governor of North retired Maj Gen G A Chandrasri and Chief Justice Asoka de Silva, the Canadian Tamils for Peace and Democracy (CaTpad) and the Forum of Srilankan Canadians for Reconciliation, Rehabilitation and Reconstruction have expressed their collective concern at the failure of Sri Lankan government to protect the most essential public trust—the judicial system.

The group points out that there has been a surge in violent acts by extremist still existing under the cover of Tamil National Alliance (TNA) politics.  According to them a few of the business run by Sinhalese in Jaffna to cater the needs for Sinhala tourist have been destroyed.

CaTpad states in their open letter that politicians supporting the Government were arrested by the order of a judge based on an anonymous letter. CaTpad questions  whether the judge acts on his own or under the influence of TNA politicians who were supporters of LTTE, which controlled the entire North and East administration.

Lenin Benedict has signed the memorandum on behalf of the Canada based Tamils and Sri Lankans bodies.

To

Your Excellency Mahinda Rajapakse
President of Srilanka
Honourable Chief Justice Asoka de Silva,
Honourable Prime Minister. D.M.Jayaratne,
Honourable Governor of North.Maj.Gen.G.A.Chandrasiri,
Public Trust on Justice system is Essential - Protect It Now

We regret to inform your excellency to express our collective alarm at the failure of government to protect our most essential public trust - our Justice system. Nothing is more essential to public, other than security and trust in our justice system. Yet, in recent months our governments have remained silent while there has been a surge in violent acts by extremist still existing under the cover of Tamil National Alliance politics.

After Mr.Suresh Premachandren M.P spoke that Sinhala businessmen are occupying the Peninsula, a few of the business run by Sinhalese in Jaffna to cater the needs for Sinhala tourist have been destroyed after his speech as reported by the press. Also there have been a huge cry by TNA politicians in recent times and their mouth piece Uthayan paper, that law and order situation is deteriorating in North and East. It is creating a huge doubt that the  communal forces within TNA using extremist tiger elements in North and East to create such a situation to get the backing of foreign powers to intervene in Srilankan affairs. This claim by TNA have been backed by the LTTE media operating in EU, Australia, New Zealand and in North America.

The recent arrest of Government supporting politicians by the order of a judge for a anonymous letter, surprises us whether the judge acts on his own or under the influence of TNA politicians who were supporters of LTTE, which controlled the entire North and East administration under previous Mr.Ranil Wickremasinghe government, which endorsed the rule of LTTE. During this period, LTTE has planted its supporters throughout the North and East administration.        Your Excellency will be aware of LTTE run courts in Vanni and other parts of North and East. We suspect whether these LTTE appointed judges are still in power to act in support of LTTE and damage the government popularity and we fear will it be possible to run a  government, even if a democratic Provincial Government takes over control especially in the North. Therefore, we request Your Excellency to intervene, and to appoint a commission to enquire the posting made at the time of LTTE control and to have a thorough check all appointments made by then.

We also ask Your Excellency, that you act swiftly to ban the communal speeches made by TNA politicians which will further damage the unity and peace of the country which has a long history of Tamil Nationalist  politics which pave the way for Tamil extremism. The call by TNA politicians openly to mourn for the death of the Terrorist leader is a clear indication of their support to Terrorism and Separatism.

We call upon Your Excellency today to act in the public interest appointing a commission under Chief Justice to investigate the appointments made at the time of LTTE regime authorized by Mr.Ranil Wickremasinghe Government and by legislating a ban on communal speeches by all politicians irrespective of communities, to ensure our most basic rights to live without fear.

Yours truly,

Lenin Benedict on behalf of
