The quest for evidence PDF Print E-mail
A further disgusting attempt to tarnish Sri Lanka’s image in the International territory, US’s move of interrogating General Sarath Fonseka for alleged war crimes against Defense Secretary Gotabhaya Rajapaksa depicts the fact that more such crude regards to the matter would arise.

The mere incident in the persuasion for questioning the former Chief Defense Staff indicates the desperation of US to gather a shred of proof against the so called human rights issues we are being hampered with.

General Sarath Fonseka is one of the most prominent Characters etched in the hearts of the People of Sri Lanka where the military victory over the LTTE is concerned. The respect and devotion showed to him is no secrecy, when the simple evidence of hundreds of banners and posters with his military form and words of gratitude towards his service for the country, is hung around every inch of the Island. A solid reason to be stated when the opposition Leader Ranil Wickremasingha and Chandrika Kumarathunga has also showed their concern over the matter in the persuasion from the US state department of the interrogation of Sarath Fonseka.

Defence Secretary Gotabhaya Rajapaksa stated that the government would do everything possible to thwart US moves to use Chief of Defence General Sarath Fonseka as a source against the Sri Lankan political and military leaders. The government had acted swiftly and decisively when Gen. Fonseka had brought the planned US action to his notice, the Defence Secretary said stated today.
It is further revealed by parliamentary MP Wimal Weerawansa that Defense Secretary Gotabhaya Rajapaksa was also questioned by US immigration authorities on his arrival in the US as a member of the Sri Lankan delegation attending the UN General Assembly this year. The reasoning for such interrogation is again the post war accusation of war crimes committed, as accused, by SL defense forces.
It is definite that the post LTTE league is behind the scenario though what they are trying to achieve is another question.

The real question that concerns the most would be, General Sarath Fonseka being demanded by the Department of Homeland Security to be held for investigations implemented by court actions since he is a U.S. green card holder which is a prelude to becoming an American citizen.

As Fonseka holds the status of a Resident Alien in the U.S. the legal framework available to the Human Rights Violators and War Crimes Unit of the Department of Homeland Security (DHS) has a greater hold on him. The unit came into existence with the creation of the Immigration and Customs Enforcement (ICE)

To look at a possible legal pursuit against General Fonseka let us look at some standing points of law depicted by the DHS.

The unit to manage the national activities of the new agency particularly specializes in law enforcement discipline. This unit is the Human Rights Violators and War Crimes Unit. The unit’s mission is twofold. The first part is to prevent the admission of foreign war crimes suspects, persecutors and human rights abusers into the United States. The second part is to identify, prosecute and ultimately remove such offenders who are already unlawfully in the United States and who have committed acts ranging from genocide, torture and war crimes to serious violations of religious freedoms or other forms of persecution

The version in which the State Department official documents which ware released this October, states of a number of accusations of war crimes and human rights violations committed, regarding with the manner with Sri Lanka executed the military defeat against the Tamil Tigers. USG are of the opinion that those who executed the war were guilty of serious atrocities committed as accused in the battle field. General Fonseka falls into that category.

The DHS has the legal authority to bring pressure and even coercion on persons like General Sarath Fonseka to submit to the State Department for interrogation to target Sri Lanka’s defense secretary Gotabhaya Rajapaksa who is a citizen of the U.S.

The State Department report released in October, though based on ambiguous information, conflicting data and insubstantial evidence reports, accused Sri Lanka of war crimes, atrocities and even genocide. The legal policy of the US government is in the position to investigate and inquire these allegations.

Meanwhile Sources said that the government had to intervene at the highest level recently when the US blocked a previously arranged visit to the US by Navy Commander Vice Admiral Thisara Samarasinghe. Nothing could be as ridiculous as this against the backdrop of continuing US –Sri Lanka military-to-military training programmes.

Such conspiracies are a result of swimming upstream regardless of the western submersions trying to sabotage the independency the Government is expressively showcasing.

The typical western Influence that does not seem to penetrate to the core of our stabilization, seems to make a raw head mark upon our US friends. No wonder it is a bitter pill for them to swallow for the pompous westerners who had indulged themselves as the superiors of the modern world. They are trying to frame anything and everything that comes under their secluded pathway to overcome our regime for freedom.
