SC orders access to disabled PDF Print E-mail
Yesterday the Bench comprising Chief Justice Asoka de Silva, Justices Saleem Marsoof and S.I. Imam directed that steps be taken to provide easy access to disabled persons to public buildings.

The bench made this direction when the Fundamental Rights petition filed by Dr Ajith C.S. Perera who is the Chief Executive/Secretary General of IDIRIY was taken up for hearing.

Court recognized in terms of the Protection of Rights of Persons with Disabilities Act and regulations made there-under, no person should be discriminated on the ground of disability and their mobility restricted in a manner which precludes or impedes them from gaining reasonable physical access to public buildings and facilities provided within such buildings, especially toilet facilities.

Dr. Perera, the petitioner complained to Court there is disability and discrimination affecting disabled people of Sri Lanka is continuing. Therefore it denies the productive opportunities as equal partners in national development.

Court ordered all new public buildings should provide reasonable access to those who are physically challenged in accordance with the regulations in force. Failure to do so would attract punitive repercussion as set out in the law.

The petitioner cited the Chairman of the National Council for Disabled Persons, Social Welfare, Ministry Secretary, Minister of Social Services and 68 others as respondents.
